These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and the individual operator of Velvet Night, located at TC 52/909-1, Trivandrum, India ("we", "us", or "our"), governing your access to and use of the Velvet Night mobile application and related services (collectively, the "App" or "Service").
By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.
You and we acknowledge that this agreement is concluded solely between you and us, and not with Apple Inc. or its subsidiaries. We, not Apple, are solely responsible for the App and its content.
Apple has no obligation to provide maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.
You and we acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
The App is intended strictly for adults aged 18 years or older (or the age of majority in your jurisdiction, whichever is higher).

Velvet Night provides access to original romantic audiobooks and stories that feature high sensual tension and mature romantic themes. All content is intended to be tasteful and non-explicit. The App does not contain pornography, graphic sexual acts, or illegal content.
The App operates on a freemium model. Free users may access limited content that includes advertisements. Paid subscribers receive an ad-free experience (subject to the subscription terms).
If you use the App without a paid subscription, the Service may display advertisements, including advertisements served by Google AdMob (the Google Mobile Ads SDK) and other third-party advertising partners.
By using the free version of the App, you acknowledge and agree that:
We do not control the content of third-party advertisements. Advertisements are the sole responsibility of the respective advertisers and advertising networks (including Google). We are not responsible for the accuracy, legality, or appropriateness of any advertisement.
Details about how advertising-related data is collected and used are explained in our Privacy Policy. You can manage certain advertising preferences through your device settings (e.g., Limit Ad Tracking on iOS or Opt out of Ads Personalization on Android) and, where available, through in-app consent tools.
You agree not to block, interfere with, or attempt to circumvent the display of advertisements in the free version of the App through unauthorized means (except through legitimate device-level privacy settings).

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable, non-sublicensable license to download and use the App on devices that you own or control, solely for your personal, non-commercial use, in accordance with the usage rules of the Apple App Store or Google Play Store (as applicable).
You may not copy, modify, distribute, sell, rent, lease, reverse engineer, or create derivative works from the App.
Certain features or content may require a paid subscription or in-app purchase.
Paid subscriptions generally remove advertisements. You can manage or cancel subscriptions through your Apple ID or Google Play account settings.

All content, stories, audio, text, graphics, logos, and software in the App are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited license to access and listen to the content for personal use only. You may not record, redistribute, publicly perform, or create derivative works from the content.
Your use of the App is also governed by our Privacy Policy, which includes information about advertising and data used for ads. By using the App, you consent to the practices described in the Privacy Policy.
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
We do not guarantee that the App will be uninterrupted, error-free, or free of viruses. We are not responsible for the content of third-party advertisements.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the App or any advertisements displayed in the App.
Our total liability to you for any claim arising out of these Terms or the App shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold us harmless from and against any claims, damages, losses, liabilities, and expenses arising out of your use of the App or your violation of these Terms.
We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms.
You may stop using the App and delete your account at any time.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms shall first be attempted to be resolved amicably. If not resolved, the dispute shall be subject to the exclusive jurisdiction of the competent courts in Trivandrum, Kerala, India.
For users in the European Union / United Kingdom: Nothing in these Terms affects your mandatory statutory consumer rights under applicable EU or UK law.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App. Your continued use of the App after the changes become effective constitutes acceptance of the revised Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
