This Privacy Policy explains how the individual operator of Velvet Night, located at TC 52/909-1, Trivandrum, India ("we", "us", or "our"), collects, uses, stores, shares, and protects your personal data when you use the Velvet Night mobile application and related services (the "App" or "Service").

By using the App, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, please do not use the App.

We are committed to protecting your privacy and complying with applicable data protection laws, including India's Digital Personal Data Protection Act, 2023 (DPDP Act), the EU/UK General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA/CPRA), and the requirements of the Apple App Store and Google Play Store.

We act as the Data Controller (under GDPR) and Data Fiduciary (under India's DPDP Act) for the personal data processed through the App.

2. Age Restriction – 18+ Only

The App is strictly intended for users aged 18 years or older.

We do not knowingly collect personal data from anyone under 18. If we become aware that we have collected personal data from a minor, we will delete it as soon as possible. If you believe a minor has provided us with personal data, please contact us immediately at velvetnightapp@gmail.com.

We do not directly collect or store payment card details. All payments and subscriptions are processed by Apple App Store or Google Play Billing. We only receive limited transaction information (e.g., subscription status) from the app stores.

We do not collect sensitive personal data such as precise geolocation, biometric data, health data, or financial account numbers.

4. How We Use Your Data

We use your personal data for the following purposes:

To provide and operate the App (legal basis: Contract / Legitimate Interest).
To create and manage your account (legal basis: Contract).
To process subscriptions and restore purchases through Apple App Store or Google Play Billing (legal basis: Contract).

Storage: Your data is stored on secure servers. We implement appropriate technical and organisational measures, including encryption in transit (HTTPS/TLS) and access controls.

Retention:

Account data is retained for as long as your account remains active.
After account deletion, we delete or anonymise personal data within a reasonable period, unless we are legally required to retain it longer (e.g., for tax, fraud prevention, or legal claims).
Usage and log data are generally retained for a limited period for security and improvement purposes.

Where required (especially under GDPR), we use appropriate safeguards such as Standard Contractual Clauses or rely on adequacy decisions.

9. Cookies, Tracking & Advertising Technologies

The App may use:

Ad performance measurement provided by the Google Mobile Ads SDK. We do not use a separate analytics or crash-reporting product.
Google AdMob (the Google Mobile Ads SDK) and related advertising technologies (for free users).

We do not track you across other companies' apps or websites, and we do not share your data with data brokers.

On iOS, Velvet Night requests non-personalised ads only and does not use your device's Advertising Identifier (IDFA). Because we do not track you, no App Tracking Transparency prompt is shown. Ads may still be selected using non-personal context such as your country and the fact that you are using this app.

In regions where consent is required, we show Google's consent form the first time you open the App, and you can change your choices any time from Settings → Ad Privacy Choices. You can also limit ad tracking through your device settings.

10. Children's Privacy

The App is not directed at children under 18. We do not knowingly collect personal data from children. If we learn that we have collected such data, we will delete it promptly.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated version in the App and updating the "Last Updated" date. Your continued use of the App after changes become effective constitutes acceptance of the revised Policy.
